Ahimsa and Zachary discussed the patentability of Al and Blockchain technologies, recent changes in how traditionally defensive patent holders have prioritized monetization of their patent portfolios, and the shift in the litigation landscape in terms of the rising occurrence of litigation funders and how they impact which entities are suing and being sued for patent infringement.

Lessons Learned: Securing Innovation in Public-Private Partnerships

In the past twenty-five years, public-private partnerships (PPPs) have emerged as an essential feature of the global development and innovation policy landscape. These joint governance arrangements and collaborative partnerships have cut across firm, industry, and geographic boundaries in unprecedented ways. From projects focusing on large-scale public service delivery and public infrastructure, to sustainability, green energy, agriculture, and public health and education, PPPs have played a central role in recent global conversations and practice.

Joining this conversation in the last decade, patent and contract scholars have argued that public-private partnership agreements have the potential to promote innovation, to comprehensively address non-intellectual property rights barriers to technology transfer, to facilitate access to green technologies, and to achieve public health goals through the pooling of resources and expertise, increasing knowledge sharing and operating efficiency, and reducing duplication of efforts and mistakes.

Yet despite the rising-star status of PPPs, a significant number of unresolved questions and issues remain as to the form, function, and impact of PPPs. This talk will focus on one seemingly recurring issue of PPPs—the failure of many to fully plan for and contract effectively for securing (or at least managing) intellectual property rights and downstream commercialization and access.

On February 4, 2024, the Federal Circuit came together for the first time in years to sit en banc in LKQ Corp. v. MG Glob. Tech. Operations LLC—a case that will reshape the obviousness standard for how design patents are granted and litigated. We will discuss why design patents can still be a valuable component of any patent portfolio and provide strategies for prosecuting design patents. We will discuss strategies for maximizing total profit damages under 35 U.S.C. §289 in view of recent Federal Circuit precedent in the Columbia v. Serius case.
